Nabytí služebnosti

§ 1260

(1) Služebnost se nabývá smlouvou, pořízením pro případ smrti nebo vydržením po dobu potřebnou k vydržení vlastnického práva k věci, která má být služebností zatížena. Ze zákona nebo rozhodnutím orgánu veřejné moci se služebnost nabývá v případech stanovených zákonem.

(2) Při vydržení služebnosti odpovídající veřejnému statku je vydržitelkou obec, na jejímž území se věc nalézá.

§ 1261

Pozemek určený k plnění funkcí lesa lze zatížit pozemkovou služebností, služebností pastvy nebo služebností braní lesních plodů jen smlouvou, pořízením pro případ smrti nebo rozhodnutím orgánu veřejné moci. Taková služebnost může být zřízena jen jako vykupitelná a podmínky výkupu musí být již při zřízení služebnosti předem určeny.

§ 1262

(1) Zřizuje-li se právním jednáním služebnost k věci zapsané ve veřejném seznamu, vzniká zápisem do takového seznamu. Vzniká-li služebnost k věci zapsané do veřejného seznamu na základě jiné právní skutečnosti, zapíše se do veřejného seznamu i v takovém případě.

(2) Zřizuje-li se služebnost k věci nezapsané ve veřejném seznamu, vzniká účinností smlouvy.
