Daňové přiznání a placení daně

§ 110zb

Zdaňovací období

Zdaňovacím obdobím je pro účely zvláštního režimu jednoho správního místa

a) kalendářní čtvrtletí v případě režimu mimo Evropskou unii a režimu Evropské unie,

b) kalendářní měsíc v případě dovozního režimu.

§ 110zc

Daňové přiznání

(1) Uživatel je povinen podat daňové přiznání do konce kalendářního měsíce následujícího po skončení zdaňovacího období, a to i v případě, že za příslušné zdaňovací období neuskutečnil vybrané plnění.

(2) Připadne-li poslední den lhůty podle odstavce 1 na sobotu, neděli nebo svátek, je posledním dnem lhůty tento den.

§ 110zd

Dodatečné daňové přiznání

(1) Pokud uživatel zjistí, že daň má být vyšší nebo nižší než poslední známá daň, a je povinen provést opravu daně, nebo využije svého oprávnění provést opravu daně, uvede ji nejpozději v dodatečném daňovém přiznání, které je součástí daňového přiznání za zdaňovací období, ve kterém se uživatel dozvěděl o skutečnostech rozhodných pro tuto opravu; důvody pro uvedení opravy daně a den zjištění rozdílu oproti poslední známé dani se neuvádí.

(2) Podání dodatečného daňového přiznání z jiných důvodů, než jsou důvody podle odstavce 1, není přípustné.

(3) Opravu daně podle odstavce 1 nelze v dodatečném daňovém přiznání uvést po uplynutí lhůty pro opravu daně ve státě identifikace, která činí 3 roky; lhůta pro opravu daně počne běžet dnem, ve kterém uplynula lhůta pro podání původního daňového přiznání.

(4) Připadne-li poslední den lhůty pro opravu daně ve státě identifikace na sobotu, neděli nebo svátek, je posledním dnem lhůty tento den.

(5) Daň dodatečně tvrzená uživatelem je splatná v náhradní lhůtě splatnosti, která je shodná s lhůtou pro podání daňového přiznání, ve kterém uživatel uvedl příslušnou opravu daně.

§ 110ze

Vyčíslení daně

(1) Daň se vyčíslí v eurech s přesností na 2 desetinná místa bez zaokrouhlování.

(2) Pro účely vyčíslení daně v eurech se pro přepočet použije směnný kurz

a) Evropské centrální banky zveřejněný pro

1. poslední den zdaňovacího období, nebo

2. nejbližší následující den, pokud pro poslední den zdaňovacího období není kurz zveřejněn, nebo

b) použitý u původního plnění v případě vyčíslení daně, pokud jde o podání dodatečného daňového přiznání.

§ 110zf

Předepsání a stanovení daně

Správce daně na základě podaného daňového přiznání nebo dodatečného daňového přiznání předepíše do evidence daní výši tvrzené daně nebo rozdílu a daň nestanoví.

§ 110zg

Postoupení daňového přiznání a platby

Správce daně postoupí správci daně státu spotřeby v odpovídajícím rozsahu

a) údaje z podaného daňového přiznání nebo dodatečného daňového přiznání a

b) poukázanou platbu nejvýše do výše tvrzené daně.

§ 110zh

Platba bez dostatečného označení

Pokud uživatel neuvede, na kterou daň je platba určena, nebo neoznačí platbu referenčním číslem příslušného daňového přiznání, použijí se obdobně ustanovení daňového řádu o platbách vykonaných bez dostatečného označení daně. Neodpoví-li uživatel ve lhůtě stanovené správcem daně, vrátí mu správce daně tuto platbu.
